Collection of Employer Delinquencies

Our attorneys regularly engage in the collection of delinquent employer contributions under ERISA by drafting collection policies, consulting with the fund office and unions, working with employers on developing payment plans, assisting fund auditors in the preparation of audits, and arbitrating and litigating in federal court. Through our over 40 year experience in serving ERISA benefit plans, our attorneys are well versed in the variety of issues typically involved in collecting delinquencies, including alter ego entities, single employers, and successor employers. We work with the fund to minimize the cost of collecting delinquent contributions by advising on the likelihood of success in collecting on judgments, and seeking interest, liquidated damages, audit fees, and attorneys’ fees.
